2008 SENATE BILLS
1. SB 127 (Kuehl) - Requires that, in the case of the transfer of real property or the sale of a mobilehome or manufactured home, the transfer or resale disclosure requirements be made within 10 days of a fully signed contract to purchase the property rather than by close of escrow.

2. SB 541 (Alquist) - Prohibits park management from requiring that the buyer of a mobilehome in a mobilehome park be denied residency solely on the basis of a 3:1 income-to-rent standard, without taking into consideration the buyer's other financial assets.

3. SB 900 (Corbett) - Would restore regulations and restrictions on the condo-conversion of mobilehome parks. With the veto of AB1542(Evans), SB 900 is now the legislation to address this important statewide problem. SB 900 will eliminate scam conversions that have caused economic eviction; Provides for approval of a majority of residents before conversion; Provides lots be offered at values determined by 3rd part appraisers; Allows rent protection to continue if homeowner chooses not to purchase lot.

oooo UPDATE--Senator Corbett has very reluctantly withdrawn the bill just before it was heard in the Assembly Housing and Transportation Committee as some municipalities and some mobilehome organizations strongly opposed the shift in legislative intent the bill took as amended. The bill was amended whereby 1. HCD guidelines will determine eligibility for those who are non-purchasing/low income and prevents post conversion pass-through costs from being passed on to low-income residents. 2. Extends rent protection to non-purchasing moderate income households as they do not have any protection under current law and 3. Provides rent protections to residents not categorized as low nor moderate income levels over a six-year period.
4. SB 1234 (Correa) is a new bill which if signed into law will curtail park management from trespassing on residents lots. Many mobilehome residents throughout our state have complained about park managers coming up on their porches and peering into windows in an attempt to catch minor park rules and regulations violations. One resident even caught his park manager shooting a flash camera into a window! This bill evolved as a result of complaints received by John Tennyson and Senator Correa's Staff. It will require park managers to give proper notification to park residents prior to entering their lots.

2008 ASSEMBLY BILLS
1. AB 285 (Garcia) - Restricts rent control protections. Bill has been amended to apply only to mobilehomes used as "vacation homes", in which case rent control protections will not apply.

oooo Update--Bill was "killed" in The Assembly Housing Committee on January 16, 2008 as it only received two votes!
2. AB 460 (Cook) - Requires that, as a condition of resale in place in the park, 1975 and older (pre-HUD) mobilehomes be inspected inside and outside by a private home inspector and that any violations be brought up to code in accordance with HUD regulations.

3. AB 1111 (DeSauliner) - Protects existing 55 and over age parks. Requires mobilehome park management to obtain the consent of 51% of the park before changing an existing park rule limiting residency in the park to seniors.

oooo UPDATE - Will be heard January, 2008 in Assembly Housing Committee. Was amended to give local governments the right to protect existing 55 and over age parks. Has "passed" on the Assembly Floor and now advances to the Senate Judiciary Committee. Passed in Senaate Judiciary COmmittee. It now advances to the Senate Floor.
4. AB 1309 (Calderon) - As amended, the bill now provides that upon a new tenancy, space rents would increase a minimum of 20% or 70% of fair market rents as determined by an appraiser, whichever is higher.

oooo Update--Bill has by passed the Judiciary Committee and will go directly to the the Assembly Floor for a vote before the end of January! Please contact Assembly Member Mary Hayashi and ask her to vote "NO". Bill was "pulled" by its author before it reached the Assembly Floor on the grounds that there was not enough support for its passage.
AB 952 (Mullin) - Bill would give low income residents living in Common Interest Developments, up to one year to pay assessments levied by HOA. On Senate Floor. Support
AB 2050 (Bonnie Garcia) - New Bill. This bill is sponsored by HCD. It clarifies the requirement of a homeowner to obtain a permit when they undertake remodling of their mobilehome; It changes state law to permit use of hot water heaters used for conventional site-built dwellings for instaallation in mobilehomes, so long as they are properly installed, strapped, etc. This will save homeowners money because hot water manufactured for mobilehomes are usually far more expensive than a hot water heater that can be purchased at Home Depot. The bill will also clarify law that smoke detectors must be installed in mobilehomes, and selling mobilehome owners will need to sign a form when they sell their mobilehome stating that the required smoke detectors have been installed. Not yet assigned for hearing, but will most likely be heard in Assembly Housing Committee.
